Canadian labour laws question

I have looked up the laws online, government web site,but need clarification.

Web site says standard work week is 40 hours. Anything over that is overtime.

Can employers change that number??? Say, only pay OT after 44 or 48 hours?

**HR exec in the US for almost 30 years

I looked at a site workershelp dot ca slash overtime and there are some differences between the providences. Alberta for example is listed first and states after 8 hrs in a day or 44 in a week.

I don’t know if this is a government site or provided by a law firm which is common in the US.

Maybe check it out?

BC:Daily: Time + 1/2 after 8 hours, double time after 12 hours

Weekly: Time + 1/2 after 40 hours

Alberta: Time + 1/2 after 8 hours a day or 44 hours a week

Saskatchewan: Time + 1/2 after 8 or 10 hours a day or 40 hours a week

Manitoba: Time + 1/2 after 8 hours a day or 40 hours a week

Ontario: Time + 1/2 after 44 hours a week

Quebec: Time + 1/2 after 40 hours a week

New Brunswick: Not less than minimum wage + 1/2 after 44 hours a week (minimum overtime wage rate is $17.63)

Nova Scotia: Time + 1/2 after 48 hours a week

PEI: Time + 1/2 after 48 hours a week

Newfoundland: Minimum overtime wage $18.23 in excess of 40 hours per week

Yukon: Time + 1/2 after 8 hours a day or 40 hours a week

NWT: Time + 1/2 after 8 hours a day or 40 hours a week

Nunavut: Time + 1/2 after 8 hours a day or 40 hours a week

Federal: Time + 1/2 after 8 hours a day or 40 hours a week

I was on the government of canada web site. Doesn't give any details about difference by province.

Of course that site also says that changes to work hours must be approved by 70% of employees when not unionized and posted 30 days in advance.

Wh employer changes hours monthly, sometimes weekly. One week 6am - 5pm mon-thurs, fri 6-12 with saturdays available to the next week mon-thurs 6-3, fri same but saturday only offered to SOME people. Its annoying as fuck! They can ONLY make the standard number of hours/week IF they work saturday and its not offered to everyone.

Just seems sneaky and bullshitty to me.

Especially since they take away work for the guys working during the week and give those extra hours to the select few working saturdays.

As an example lets say theres two groups of workers. The guys who paint and the guys who drywall. Saturdays the drywallers are painting...work which could have been done by the PAINTERS during the week if they had worked full hours until 5pm instead of being sent home at 3.

On these short weeks the only person staying is the foreman who sits in his office for two hours doing nothing while everyone else leaves at 3. He also is the only one making OT hours. And thats starting to piss off the other employees.

It was a federal/provincial site.

Also, it can be written into contracts when that limit is and in some contracts hours can be banked for days off (I worked in municipal government for 7 years and that is what I always did. One year I banked over 22 days on top of my regular 14. :-)

Yes employers can play fast and loose with the rules and change things up at will. sucks.

It is frustrating that now that we have nice weather they are making the guys work 6 days a week when it can all be done during the week so they could have weekends off. I know legally they only require one day of rest but dammit when you work construction and hard its nice to have two days off in a row. Also most of the guys are young with no families so they don't care while those with families are told suck it up work matters more than family. Our society is fucked up beyond words.

And the overtime should be nation wide. Makes me want to move...

That does suck...I was a chef for many years and my one employer used to book me one day off then 6 days on...THEN 6 days on and 1 day off, so most of the time I was working 12 days in a row.

I used to do 3 17 hour shifts. With eight hours in between 3pm-10pm then 10pm-8am. Come back at 3pm. Was brutal.

Work all our lives to finally be able to enjoy life but so damn old you end up dying before you can enjoy it. Fuck that shit.
